Welcome to mysEaLearn (hereafter the "Service"). The Service offers Users access to information and learning resources, allows communication with other members and such other features integral to the Service. The Service is owned and operated by IDESS Interactive Technologies (IDESS IT) Inc., at Bldg. 8348 Bohol Road Upper Cubi, Subic Bay Freeport Zone, Philippines.
By using the Service, you accept and agree to the terms of this Agreement, whether you are a "Visitor" (which means that you simply browse the Service’ Website) or you are a "Member" (which means that you have registered with the Service). The term "User" refers to a Visitor or a Member. You are only authorized to use the Service (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and to this Agreement. If you do not agree to these terms, you are not authorized to use the Service.
IDESS IT reserves the right to change the terms of this Agreement from time to time, and any modification shall be effective upon posting in the Service’s website. It is the responsibility of each User to review this Agreement periodically to make sure that such User is current on the terms of this Agreement.
3. PERSONAL INFORMATION
3.1 Registration. When a User registers to be a Member of the Service, the User must provide contact information and general information about the User. The User is responsible for the accuracy and completeness of information and for the security of registration details.
This information is maintained under “My Profile” which the Member controls. Information collected in a Member profile is used to better understand the Member's use of the Service and to support related transactions made on the website. The Service may also use Member profile information to occasionally notify Members about important functionality changes to the website, offerings and services.
3.2 Password. As part of the registration process, each User will provide a Password. The User is entirely responsible for maintaining the confidentiality of his/her password.
You agree not to use the account, username, or password of another Member at any time or to disclose your password to any third party. You agree to notify the Service immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.
Modifying/Updating or Removing Information. IDESS IT aims to maintain the accuracy of information in its site. For this purpose, Users may access their own personal information and modify or delete any inaccuracies of their personal information and update their profile, at any time by logging into their account and accessing features such as Edit My Profile.
3.3 Security. Member accounts are secured by member-created passwords. The Service takes precaution to ensure that member’s personal information that is stored within our database is kept private unless authorized by the Member under the Service’ Settings that his personal information will be displayed in Public for other Users to view.
The Service implements a variety of standard web security measures to maintain the safety and security of Members' personal information. IDESS IT restricts access to Member’s personal information to those employees who need access to perform their job functions, such as our customer service personnel and technical staff, and to pursue legitimate interests of IDESS IT as may be permitted by law.
It is recommend that, if a Member shares a computer, or uses a computer that is accessed by the general public (i.e., a school or library, etc.), the Member should log-out from the Service and close the browser window when finished with a session. This will help to ensure that others cannot access a Member's personal information.
Please note that we cannot guarantee the security of Member’s personal information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of the member’s personal information at any time. 3.4 Log Data. The Service automatically records information ("Log Data") which may include non-private personal information such as your IP address, browser type, the referring domain, pages visited, your mobile carrier, device and application IDs, and search terms created by your use of the Service. Other actions, such as interactions with our website and advertisements may also be included in the Log Data.
The Service keeps Users' records/logs and other information as required for legal and administrative purposes only.
We do not actively market to children, and we do not knowingly ask for and collect personal information from a child under eighteen (18) years of age (the “child”). Upon learning that a child has provided us with personal information, we unilaterally delete the information within a reasonable time and terminate the child’s account. However, except for personal information, other types of information collected in the course of the child’s use of our services may remain in the system. Also, there is no guarantee that the information provided by the child was not used prior to the deletion. If you become aware that a child has provided us with personal information without parental consent, please contact us at email@example.com.
4.1 Term. This Agreement shall remain in full force and effect while you use the Service or are a Member. You may terminate your Membership at any time, for any reason. The Service may terminate your Membership at any time, without notice.
4.2 Non-transferability of Membership. The Service grants to each Member a personal, revocable, non-exclusive, non-assignable, and non-transferable license to use and display the information offered by the Service on any machine(s) of which the Member is the primary user. Each Member acknowledges by becoming a Member that the Member may not sub-license, transfer, sell, or assign this license. Any attempt to sub-license, transfer, sell, loan, or assign the license is void, is of no effect and may result in the immediate termination of the Member's membership.
4.3 Invitations and Other Communications to Non-members. Members can invite friends to join the Service by sending invitation e-mails through our automated invitation system. The Service does not sell these e-mail addresses or use them to send any other communication besides invitations. Recipients of invitations from the Service may contact us to request the removal of their information from our database.
4.4 Deactivation of Membership. As registration to the Service is free, it is assumed that a Membership will have an indefinite term and is effective until deactivated by the Member of the Service. A Member may deactivate his or her account at any time by going to Settings and selecting Deactivate Account.
IDESS IT may terminate a Member's Account or access rights to the Service immediately without notice, if in IDESS IT’s sole discretion, a Member fails to comply with any term or provision of this Agreement.
5.1 Collected information upon registration. When you create or update a Member account, you provide some personal information, such as your name, username, password, birthdate, country, and e-mail address. All information that you voluntarily provide, for example, your name and username, are collected and processed by IDESS IT and listed publicly on our Services, including on your profile page and in search results. Some Services, such as Training Record, public Member profiles and viewing list of learning resources, do not require registration.
5.2 E-mail Address. The Service may also use e-mail addresses and other personally identifiable information to communicate with Members who initiate communications with the Service.
We may use your e-mail address to send you information about our Services or to market to you. You may unsubscribe from these messages by following the instructions contained within the messages or the instructions on our website. If you e-mail us, we may keep your message, e-mail address and contact information, and computer details (if available) to respond to your request.
The Service does not sell e-mail addresses or other general information that Members provide to other parties.
Additional Information. You may voluntarily provide us with additional information to make public, such as curriculum vitae (CV), certificates, travel documents or a picture. You may customize your account with information, etc. so that we can help you find other Members of the Service that you know. Providing the additional information described in this section is entirely optional.
5.3 The Service is primarily designed to help you share information with the world. Most of the information you provide to us is information you are asking us to make public. This includes not only the messages and notes you write about content and forum posts, but also any other place where you are able to type. The metadata provided with the Service, such as when you are certified, shows up in your public profile page. Our default is almost always to make the information you provide public but we generally give you settings to make the information private if you want.
Your public information is broadly and instantly disseminated. For example, your public information is searchable by many search engines. Users should be careful about all information that will be made public on the Service (such as your Member profile, comments and testimonials), not just posts. Under the Agreement, all registration information submitted must be truthful and accurate. It is very important that you enter only valid information, then set your profile to private if you wish.
5.5. We aim to maintain the accuracy of our information. For this purpose, Users may access their own personal information any time and change any inaccuracies they may find by updating their profile. Members may also delete their information from our database by updating their profile or sending us a support ticket to deactivate their account.
Any organisation that wishes their Members (employees, students, etc.) to take advantage of the Service’s free-registration and learning resources are welcome, at no charge, to link to the Service’ website.
6. INTELLECTUAL PROPERTY RIGHTS
6.1 The Service contains learning resources (“Content”). The Content is protected by copyright, trademark, patent, trade secret and other laws, and IDESS IT owns and retains all rights in the Content and the mysEaLearn Services.
Members acknowledge that the duplication and/or redistribution, whether in electronic or printed format, of Content, information, data, or other intellectual property gained through access to the Service to any other non-Member or party is a violation of applicable copyright laws and causes harm to IDESS IT and the Service.
6.2 The Service is also a distributor of content supplied by third-parties. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third-parties, Members, or any other User, are those of the respective author(s) or distributor(s) and not of the Service. IDESS IT does not warrant or make any representations concerning the accuracy, likely results or reliability of the Service or the Content.
7. HUDDLE POSTINGS
7.1 The Huddle is a feature wherein Members can communicate with other Members of the Service. Please be aware that whenever you voluntarily post public information to the Service, that information can be accessed by the public and can in turn be used by those people to send you unsolicited communications.
7.2 Copyright Policy. You may not post, modify, distribute, or reproduce in any way any copyrighted material, trademarks, patents, trade secret or other proprietary information belonging to others without obtaining the prior written consent of the owner of such proprietary rights. It is the policy of the Service to terminate Membership privileges of any Member who repeatedly infringes the copyright rights of others upon receipt of proper notification to the Service by the copyright owner or the copyright owner's legal agent.
7.3 IDESS IT shall have the right, but not the obligation, to reject, refuse to post or remove any posting by the User, or to restrict, suspend, or terminate a User’s access to all or any part of the Service in the sole discretion of IDESS IT, (a) violates this Agreement (b) may be offensive or illegal or (c) harms, threatens the safety of, or violates the rights of any person, with or without prior notice and without liability.
7.4 Users shall remain solely responsible for the content of their messages posted on the Service. Each User acknowledges and agrees that neither the Service nor any third party content provider shall assume or have any liability for any action or inaction by the Service or any third party content provider with respect to any conduct, communication or posting on the Service.
7.5 Member Conduct. The following is a list of posting activity that is illegal and will result in the termination of the Member's account and membership privileges, at IDESS IT’s sole discretion, and the Member may be reported to appropriate law-enforcement agencies. IDESS IT reserves the right to investigate and take appropriate legal action against anyone who, in IDESS IT’s sole discretion, violates this provision, including without limitation, reporting you to law enforcement authorities. Prohibited activity includes, but is not limited to:
7.6 Disputes. You are solely responsible for your interactions with other Members of the Service. IDESS IT reserves the right, but has no obligation, to monitor disputes between you and other Members.
8.1 In an attempt to provide increased value to Members, the Service may provide various Ads or third-party website links from the website. However, even if the third-party is affiliated with the Service, the Service has no control over these linked sites each of which may have separate privacy and data collection practices, and all of which are independent of the Service.
9. LIMITATION OF LIABILITY
The learning resources in this Service is distributed solely for training purposes and IDESS IT disclaims any and all liability for any actions or omissions exercised in reliance to the learning resources, the material contained herein and the accompanying material. No warranty is made that the materials appearing on its site are accurate, complete or current. The entire risk arising out of the use or performance of the learning resources, the material therein and the accompanying material remains with you. You should especially be aware that all factual situations you may encounter require individual evaluation on your part and you are solely responsible for your actions or omissions.
In no event will IDESS IT be liable for any damages, including but not limited to loss of data, lost profits, lost savings, service interruptions or other indirect, incidental, special or consequential damages arising out of the use, or inability to use the learning resources even if IDESS IT has been advised of the possibility of such damages, or for any claim by any other party. IDESS IT’s liability for damages hereunder shall in no event exceed the amount paid for the learning resources under the terms and conditions of this Agreement
10. DISPUTE RESOLUTION
This Agreement and any matter arising from or in connection with it shall be governed by and construed in accordance with the laws of Singapore.
Every effort shall be made to settle any dispute amicably.
In the event an amicable resolution is not achieved, any dispute, or claim arising out of or relating to this agreement, or the breach, termination or invalidity thereof, shall be settled by binding arbitration in accordance with the Singapore International Arbitration Centre rules in force at the time.
IDESS IT, the IDESS IT logo and mysEaLearn logo are registered trademarks of IDESS IT.
Other product names mentioned may be trademarks or registered trademarks of their respective companies and are hereby acknowledged.
